These Terms of Service ("Terms") govern your access to and use of the OneImageTool website, applications, and browser-based image utilities (collectively, the "Services") operated by OneImageTool ("we", "us", or "our"). These Terms incorporate our Privacy Policy by reference.
1. Acceptance of terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old to use the Services independently. If you are between 13 and 17, you may use the Services only with the involvement and consent of a parent or legal guardian. The Services are not directed to children under 13, and we do not knowingly collect information from children under 13.
3. Description of services
OneImageTool provides free image utilities that run primarily in your web browser using client-side technologies such as Canvas and Web APIs. In Phase 1, core tools do not require an account and do not upload your image files to our servers for processing.
Optional features such as accounts, subscriptions, or server-side processing may be introduced later. If so, additional terms may apply and will be disclosed at that time.
4. License to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business purposes, in accordance with applicable law.
You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Services except as permitted by law. All rights not expressly granted are reserved by OneImageTool and its licensors.
5. Your content and data
You retain all rights to images and other content you load into our tools ("Your Content"). For browser-based tools, Your Content is processed locally on your device unless a specific tool clearly states otherwise.
We do not claim ownership of Your Content. You are solely responsible for ensuring you have the rights to use, edit, and export Your Content, and that your use complies with applicable laws and third-party rights.
6. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or to violate any applicable law or regulation.
- Upload, generate, or distribute content that is illegal, harmful, threatening, abusive, defamatory, infringing, or otherwise objectionable.
- Attempt to interfere with, disrupt, or overload the Services, including through automated scraping, denial-of-service attacks, or unauthorized access.
- Misrepresent your identity or affiliation, or impersonate any person or entity.
- Use the Services to develop a competing product through systematic extraction of our content, design, or tool logic.
7. Intellectual property
The Services, including site design, text, graphics, logos, tool interfaces, and software (excluding Your Content), are owned by OneImageTool or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not use our trademarks or branding without prior written permission.
8. Third-party links and services
The Services may contain links to third-party websites or integrate third-party analytics or payment providers. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, secure, or that outputs will meet your requirements. Image processing results depend on your device, browser, and input files. You use the Services at your own risk.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEIMAGETOOL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $50.
11. Indemnification
You agree to indemnify and hold harmless OneImageTool from any claims, damages, losses, or expenses (including reasonable legal fees) arising from Your Content, your use of the Services, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.
13. Governing law
These Terms are governed by the laws applicable in our principal place of business, without regard to conflict-of-law principles. Where permitted, disputes shall be resolved in the courts of that jurisdiction.
